Book excerpt: This is the second study in a series published by the UN Institute of Namibia, designed to stimulate discussion on the constitutional options for an independent Namibia. It opens with a wide-ranging historical survey of the evolution of the constitutional structure imposed upon the territory by South Africa after 1920. The Turnhalle Constitutional Conference is then critically examined, and it is argued that its interim draft constitution was structured on the assumption of the continued existence of the bantustan ethnic homelands and racial segregation. The authors have deliberately refrained from making detailed proposals, leaving policy formulation to Namibians at a constitutional conference, but offer a sober discussion of the major policy options with regard to the functions of the executive, the legislature, the election process, the judiciary, citizenship, human rights, state succession, and the role of political parties. It does, however, come to the categorial conclusion that a unitary rather than a federal system of government is a necessity in order to transform the fragmented and ethnically based system.
